What exactly is Estate Planning?

happy mixed race, multigenerational family

Estate Planning means you get to decide—while you’re alive and able—what should happen to your money, property, and personal matters if you become seriously ill or die. Think of it as creating a clear set of instructions for the people you care about, so they’re not left guessing during a stressful time.

Instead of leaving it to state law, a properly structured estate plan lets you decide how your assets will be divided.  It allows you to pick trusted people to carry out your wishes regarding your estate, any trusts, your finances if you’re incapacitated, and your medical decisions if you can’t speak for yourself. If you have children or dependents, you can name guardians and arrange financial support for them.

For now and then, as a solid plan covers not only death but also incapacity, so someone can step in smoothly if you’re unable to manage your affairs. Finally, clear instructions reduce confusion, conflict, probate delays, and the risk of costly family disputes.

Special Needs Planning

A Special Needs Trust is an important way to protect the future of a loved one with a disability. It’s a legal setup that holds and manages money or property for their benefit. The key advantage is that it lets your family set aside funds for their care without causing them to lose vital government benefits like Medicaid or Supplemental Security Income (SSI).

With a Special Needs Trust, money can be used for things that government programs usually don’t cover—like extra medical care, education or training, hobbies and outings, transportation, and other everyday supports. These “extras” can make a real difference in your loved one’s mental, emotional, and physical health, helping them live as independently and comfortably as possible.

Just as importantly, a Special Needs Trust gives you peace of mind. You’ll know there’s a plan in place to provide for your loved one in the years ahead, even when you’re no longer able to do it yourself.

Our Medicaid crisis planning team is designed to respond quickly, helping you access quality long-term care as soon as possible while protecting as much of your income and assets as the law allows. We act fast, explain your options in clear, plain language, and create a practical plan to protect you and yours during a difficult time.

Probate & Estate Administration

Probate (officially proving a Will): What is it?
Probate is the legal, court-supervised process that happens after someone dies. If the person left a Will, probate is how the court confirms it’s valid and makes sure everything in it is carried out. That includes paying off any debts and distributing property the way the person wanted. If there’s no Will, then state “intestacy” laws step in and decide who gets what.

Estate Administration:
Estate administration is the bigger picture. It includes probate (when probate is needed), plus the overall job of handling the estate or trust. This means collecting and managing assets, paying bills and taxes, keeping good records of money coming in and going out, and dealing with any claims or legal issues that pop up.

Common Problems:
Some estates run smoothly, but common headaches include family disagreements, how long the process can take, tracking down all assets and debts, and making sure the accounting is complete and accurate—among other challenges.

Our Goal:

To handle the details and ensure all laws are followed, affairs settled, and gifts distributed while providing the calmest, stress-free services possible.
